These Terms govern your use of Seated — the mobile app, the website, and related services. Seated is operated by Mooney Co, a software studio in Plymouth, Michigan.
By using Seated, you agree to these Terms.

1. Eligibility
You must be at least 13 years old to use Seated. If you are between 13 and the age of majority where you live, you may use it only with a parent or guardian's involvement and consent.
Seated does not require an account, so we do not collect date of birth and cannot verify age at sign-up. By using Seated you confirm you meet this requirement. If we learn that someone under 13 is using it, we will terminate that access.
You may not use Seated if you have previously been suspended from it.
2. What Seated is
Seated shows restaurant wait times reported by the people who were actually waiting. It also shows forecasts calculated from past reports, and restaurant information from public sources and from restaurants themselves.
Wait times are estimates. They may be wrong, out of date, or missing entirely. Forecasts are predictions from historical patterns and are labelled as such — they are not measurements of current conditions.
Seated is an informational tool. It is not a reservation system or a waitlist service, and it does not put your name down anywhere.
We do not guarantee the accuracy of anything in the app. Verify independently — including by calling the restaurant — before relying on it.
3. Accounts are optional
You do not need an account to use Seated. Everything works without one: browsing the map, viewing wait times, submitting reports, and saving favourites.
When you first open Seated, the app creates an anonymous identity on your device. It has no email, no password, and no personal information attached. It exists so your reports, points, and favourites stay yours, and so we can enforce these Terms — including rate limits and suspensions.
Optional accounts. You may add an email address and password. This lets you keep your history if you lose or replace your device, and sign in on more than one device. It unlocks no additional features.
If you create an account, you are responsible for keeping your credentials secure and for activity under your account. Tell us at legal@seated.site if you think it has been compromised.
Losing anonymous data. If you use Seated anonymously and delete the app, lose your device, or reset it, your history, points, and favourites are permanently lost. We cannot recover them. Adding an email address is the only protection against this.
Deleting your data. You may delete your account and personal data from within the app at any time. This removes your profile, your email if you have one, and your login. Wait reports you submitted may be retained in anonymized form, since other users rely on them and they no longer identify you.
4. Your content
You keep ownership of what you submit — wait reports, photos, and anything else.
By submitting content, you grant Seated a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, modify, display, and distribute it for the purpose of operating and improving the service.
This licence continues for content that has been aggregated or anonymized, even after you delete your account.
You confirm you have the rights to anything you submit and that it doesn't infringe anyone else's rights. We may remove content at our discretion.
5. Acceptable use
You agree not to:
- Submit false, misleading, or deliberately inaccurate wait times
- Submit reports for restaurants you have not visited or observed
- Manipulate wait data to benefit or harm any business
- Harass, threaten, abuse, or impersonate anyone
- Upload unlawful, obscene, defamatory, or infringing material
- Attempt unauthorised access to our systems or other users' data
- Scrape, crawl, or extract data by automated means
- Reverse engineer or decompile the app
- Interfere with or place undue load on the service
- Use Seated commercially without written permission
Rate limits. We limit how frequently you can submit reports. Attempting to get around them — by reinstalling the app, creating multiple identities, or automating submissions — is a breach of these Terms.
Suspension. We may suspend any account or device identity that breaches these Terms. Suspended users can still view Seated but cannot contribute to it.
Deliberately submitting false wait times degrades the service for everyone and may result in immediate suspension.
6. Restaurant listings
Restaurant details — hours, contact information, photos — may be incomplete or out of date. They come from public sources, from restaurants that have claimed their listing, and from Seated.
Inclusion of a restaurant does not imply any relationship between that business and Seated unless stated.
Restaurant owners may claim their listing to correct information and post official wait times. A claimed listing does not make Seated responsible for the accuracy of what a restaurant submits.

7. Photos
Photos of restaurants may be added by Seated or, where the feature is enabled, submitted by users who have reported a wait at that restaurant. All photos are reviewed before they appear.
Do not submit photos of people, and do not submit photos you don't have the right to share.
Every photo has a report option. If you see something objectionable, use it — reported photos are reviewed and removed where appropriate.
8. Advertising
Seated may show advertising. All ads are clearly labelled as such.
Ads are sold and reviewed by us directly. We do not use third-party ad networks, and advertisers never receive information that identifies you. Advertisers receive aggregate counts of how often an ad was shown or tapped.
Where a sponsored restaurant appears in Seated, its wait time is the same real wait time shown for every other restaurant. Payment never changes or conceals a wait time.
9. Points, levels, and badges
Seated awards points, levels, and badges for participation.
These have no monetary value, cannot be bought, sold, transferred, or redeemed, and confer no property rights. We may modify, recalculate, reset, or discontinue them at any time without notice or compensation.
10. Intellectual property
Seated — its software, branding, logos, designs, and the content we create — is owned by Mooney Co and protected by intellectual property law.
These Terms grant you a limited, personal, non-transferable, revocable licence to use Seated as intended. No other rights are granted.
Place data is © OpenStreetMap contributors, used under the Open Database License. Map rendering is provided by Mapbox.
If you believe content in Seated infringes your copyright, contact legal@seated.site with a description of the work, where it appears, and your contact details.
11. Third-party services
Seated relies on third parties for hosting, authentication, mapping, and notifications. Your use may be subject to their terms. We are not responsible for third-party sites we link to.
12. Termination
We may suspend or terminate access at any time, with or without notice, for breach of these Terms or any other lawful reason. You may stop using Seated at any time.
Sections that by their nature should survive termination — content licences, disclaimers, limitation of liability, and governing law — survive.
13. Disclaimer of warranties
SEATED IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that Seated will be uninterrupted, secure, or error-free.
14. Limitation of liability
To the maximum extent permitted by law, Mooney Co is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or time.
This includes losses arising from reliance on wait times, forecasts, restaurant details, or the availability or unavailability of the service.
Our total aggregate liability arising from or relating to Seated will not exceed one hundred U.S. dollars ($100).
Some jurisdictions do not permit certain limitations, so parts of this section may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Mooney Co from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of Seated, your content, or your breach of these Terms or applicable law.
16. Apple App Store terms
Where you obtained Seated through the Apple App Store:
- These Terms are between you and Mooney Co only, not Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price if any. To the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple is not responsible for addressing claims relating to the app, including product liability, regulatory conformity, or consumer protection claims.
- Apple is not responsible for investigating or resolving third-party intellectual property claims.
- You confirm you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and are not on any U.S. Government prohibited-parties list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
17. Governing law
These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law principles. Any dispute will be brought exclusively in the state or federal courts of Michigan, and you consent to their jurisdiction.
18. Changes
We may update these Terms. We will revise the date above, and for material changes will make reasonable efforts to notify you in the app. Continued use after changes take effect constitutes acceptance.
19. Miscellaneous
If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and Mooney Co regarding Seated. You may not assign them; we may.
